Who we are and what this covers

Telgrow, LLC (“Telgrow,” “we,” “us” or “our”) provides an AI dialer for outbound sales teams.

This Privacy Policy explains how we collect, use and share personal information when you visit telgrow.ai, demo.telgrowth.com and any other website we operate that links to this page (the “Site”), when you request a demo, and when you otherwise communicate with us about our business.

Businesses that subscribe to the Telgrow platform (the “Platform”) sign a separate customer agreement with us. For the data those customers bring to or create on the Platform, and the data we obtain for them, we act on the customer’s behalf, and the customer’s own privacy notice applies. The section “Information we process for our customers” below explains that role.

Notice at collection for U.S. state residents. The categories of personal information we collect, why we collect them, who we disclose them to and how long we keep them are described in this policy. The section “U.S. state privacy rights” explains the rights you may have.

This policy does not cover websites, apps or services run by other companies, even if the Site mentions or links to them. Their own privacy policies apply.

Information we collect

Information you give us

When you request a demo or contact us, you may give us:

  • Contact and company details: your name, work email address, company name and, if you choose to give it, your phone number.
  • Details about your needs: your team size, your industry and anything you write in the message field.
  • Phone consent record: the demo form has an optional, unticked box that lets you agree to calls and texts about your demo, including calls made with automated dialing technology, prerecorded messages or an AI voice. If you tick it, we store the exact wording you agreed to and the time you agreed. See our TCPA Notice for how we use this consent.
  • Communications: the content of emails, calls and other messages you exchange with us, including the recording and transcript of any call we record. If we record a call with you, we will tell you at the start of the call.

Please do not include sensitive personal information, such as health or financial account information, in the message field. We do not need it to respond to a demo request.

Information collected automatically

  • With each demo request: your IP address, the country we derive from that IP address, the page you sent the request from (the referring page), your browser’s user agent (which identifies your browser and device type) and the time of the request.
  • When you visit the Site: our hosting provider, Cloudflare, processes request data such as your IP address, browser details and the pages you request, so that it can deliver the Site and protect it from attacks and abuse.
  • A preference cookie: if you open a link to the Site that contains “?brand=”, the Site sets a cookie that remembers which brand look to show you. See our Cookie Policy.

The Site does not use analytics, advertising or social media tracking scripts. Its fonts are hosted on our own Site, and it does not embed content from other companies.

Information from other sources

We may receive personal information about you from service providers that help us run the Site (for example, Cloudflare tells us the country associated with an IP address), from our customers, and from parties involved in a business transaction described below.

How we use personal information

We use personal information for the following purposes, or as we describe when we collect it:

  • Responding to demo requests: to contact you, schedule and run your demo, and tailor it to your industry and team size.
  • Calls and texts: to call you about your demo. We only use texts, automated dialing, prerecorded messages or an AI voice to contact you if you gave us your consent, for example by ticking the box on our demo form. Otherwise we contact you by email or by calls placed manually by a member of our team. See our TCPA Notice.
  • Marketing: to send you emails about Telgrow’s products and services. You can opt out at any time, as described in “Your choices.”
  • Keeping records: to keep a record of your request and any consent you gave, so we can show what you agreed to and honor any request to stop contacting you.
  • Operating and securing the Site: to deliver the Site, remember your brand look preference, and filter spam using a hidden form field, a check on how quickly the form was filled in, and a limit on the number of requests from one IP address.
  • Improving our business: to understand who asks for demos (for example, which industries and team sizes) and to improve the Site, our products and our services.
  • Compliance and protection: to comply with laws, lawful requests and legal process; to protect our rights, privacy, safety and property and those of others, including by making and defending legal claims; to audit our compliance with legal and contractual requirements; to enforce our Terms of Service and Acceptable Use Policy; and to prevent, investigate and deter fraud, abuse and other harmful or illegal activity.
  • Business transactions: as described in “How we share personal information.”
  • Aggregated and de-identified data: we may create aggregated or de-identified data from personal information by removing the details that identify you, and use and share it for our lawful business purposes. We do not attempt to re-identify de-identified data, except to test whether our de-identification works as the law requires.

If we want to use your personal information for a new purpose that is not compatible with the purpose we collected it for, we will ask for your consent first.

How we share personal information

We may share personal information with the following parties, or as otherwise described in this policy or when we collect it:

  • Service providers: companies that help us run the Site and our business, such as hosting and security (Cloudflare, which stores demo requests and sends each one by email to the Telgrow team) and our email providers.
  • Professional advisors: lawyers, auditors, bankers and insurers, as needed for the services they provide to us.
  • Authorities and others: law enforcement, government authorities and private parties, when we believe in good faith that it is necessary or appropriate for the compliance and protection purposes described above.
  • Business transferees: parties to an actual or prospective investment in, financing of, or sale, merger or transfer of all or part of our business or assets, including in an insolvency, bankruptcy or receivership. We may share personal information with prospective counterparties and their advisors, and it may transfer to an acquirer, successor or assignee.
  • Parties you direct: other parties, when you ask us to share information with them or agree that we may.

We do not sell the personal information we collect through the Site, and we do not share it with third parties for cross-context behavioral (targeted) advertising.

Information we process for our customers

Our customers use the Platform to run outbound sales campaigns. Depending on how a customer uses it, the Platform may process:

  • lead lists the customer imports or connects, and records synced with the customer’s CRM (such as Salesforce, HubSpot or GoHighLevel);
  • call recordings, transcripts, coaching notes and call analysis;
  • conversations with AI voice agents and phone menus (IVRs) the customer sets up;
  • consent records, consent timestamps and audit trails;
  • the results of litigator and Do Not Call scrubbing; and
  • data enrichment results that we obtain from third-party data providers on the customer’s behalf.

This data, including data we obtain for a customer, is “Customer Data.” For Customer Data, we act as a service provider to our customer under our customer agreement. The customer decides what data to collect and how to use it, and is responsible for giving any notices and getting any consents the law requires. The customer’s privacy notice, not this policy, describes how the customer uses that information. We use Customer Data to provide the Platform to the customer and as our agreement with that customer and applicable law allow.

If a business called or texted you using Telgrow: please contact that business directly with any request about your information, including a request to stop calls. You can also send any request, including a request to stop calls or texts, to privacy@telgrow.ai. We may help route it, for example by identifying the customer involved and passing your request to them or telling you who to contact. Include the phone number that called you, the number that was called and the date and time of the call. Our TCPA Notice explains how to stop calls.

Cookies and similar technologies

The Site sets one first-party cookie, and only when you open a link that chooses a brand look. Cloudflare may also set strictly necessary security cookies when its bot protection runs. Our Cookie Policy explains these cookies and how to control them.

Your choices

  • Marketing emails: you can opt out of marketing emails by using the unsubscribe link in the email or by writing to privacy@telgrow.ai. You may still receive emails about a demo you requested or, if you are a customer, about your service.
  • Calls and texts: you can stop calls and texts from Telgrow at any time by replying STOP to a text, telling the person or AI agent on the call, or emailing privacy@telgrow.ai. See our TCPA Notice.
  • Cookies: you can block or delete cookies in your browser settings. See our Cookie Policy.
  • Do Not Track and Global Privacy Control: the Site does not track you across other websites and does not sell or share personal information, so these signals do not change how it works. If that changes, we will honor Global Privacy Control signals as the law requires.
  • Declining to give information: we need your name, work email, company, team size and industry to respond to a demo request. Your phone number is optional.

U.S. state privacy rights

If a U.S. state privacy law applies to our handling of your personal information (for example, the laws of California, Colorado, Connecticut, Texas or Virginia, together the “State Privacy Laws”), this section explains your rights. Not every right below is available in every state, some of these laws do not apply to information collected in a business-to-business context, and we may decline a request where the law allows. This section covers personal information that Telgrow collects for its own purposes. For Customer Data, contact the customer, as explained above.

Your rights

Depending on where you live, you may have the right to:

  • Know: ask what categories of personal information we have collected about you, the sources, why we collected it, and the categories of third parties we have disclosed it to.
  • Access: get a copy of the personal information we hold about you, in a portable format where required.
  • Correct: ask us to correct inaccurate personal information.
  • Delete: ask us to delete personal information we collected from you.
  • Opt out: opt out of the sale of personal information, of sharing it for targeted advertising, and of certain profiling. We do not sell personal information we collect through the Site, share it for targeted advertising, or use it for profiling that produces legal or similarly significant effects.
  • Appeal: appeal our decision on your request.
  • Non-discrimination: exercise these rights without being treated differently, as the State Privacy Laws require.

How to make a request

Email privacy@telgrow.ai and tell us which right you want to exercise. To protect your information, we verify requests by matching the details you give us with the information we hold, for example by asking you to reply from the email address you used when you contacted us. We may ask for more information if we need it to confirm your identity or your state of residence.

You may use an authorized agent to make a request for you. We may ask the agent for proof of their authority, such as a valid power of attorney or your signed permission, and ask you to confirm your identity with us directly.

To appeal a decision, reply to our decision email with the word “Appeal” in the subject line, or email privacy@telgrow.ai. If we deny your appeal, you may be able to contact your state attorney general.

Sensitive information and minors

We do not ask for sensitive personal information through the Site and do not use personal information to infer characteristics about you. We do not have actual knowledge that we sell or share the personal information of anyone under 16.

What we collected in the past 12 months

The list below summarizes the personal information we collect through the Site and in our communications, using the categories defined in the California Consumer Privacy Act. We use each category for the purposes in “How we use personal information,” and disclose it for business purposes to the recipients in “How we share personal information.” We have not sold or shared any of it.

  • Identifiers, such as your name, email address, phone number and IP address, including the phone number covered by any consent you give on our demo form. Some of these are also personal information described in California Civil Code section 1798.80(e).
  • Commercial information, such as the products or services you are considering, your demo request and its details (including what you write in the message field), and the record of any consent you give on our demo form (its wording and when you gave it).
  • Internet or other electronic network activity information, such as the referring page, your browser’s user agent, request data processed by Cloudflare and the brand preference cookie.
  • Geolocation data, limited to the approximate country we derive from your IP address. We do not collect precise geolocation.
  • Professional or employment-related information, such as your company name, team size and industry.
  • Audio, electronic or similar information, such as recordings and transcripts of calls with you, if we record a call.

Information you type into free-text fields may contain other categories of personal information not listed here.

Additional information for California residents

California’s “Shine the Light” law (California Civil Code section 1798.83) lets California residents ask about personal information a business disclosed to third parties for their own direct marketing purposes. We do not disclose personal information collected through the Site to third parties for their own direct marketing purposes. You may send questions to privacy@telgrow.ai with the subject line “Shine the Light Request.”

Additional information for Nevada residents

Nevada residents may direct us not to sell certain personal information. We do not sell personal information collected through the Site, but you may email privacy@telgrow.ai to opt out of any future sale.

How long we keep information

We keep personal information for as long as we need it for the purposes we collected it for, including meeting legal, accounting and reporting requirements, keeping records of consent, honoring requests to stop contacting you, establishing or defending legal claims and preventing fraud.

Specifically:

  • Stored demo requests: the stored record of each demo request is deleted automatically 2 years after we receive it, or 5 years after if it includes consent to calls and texts, so we can show what you agreed to and when. Copies of the notification email in our team inbox are kept under the general rule above.
  • Requests to stop calls or texts are kept for at least 5 years, so we can keep honoring them.

For other information, we consider the amount, nature and sensitivity of the information, the risk of harm from unauthorized use or disclosure, whether we can achieve our purposes in other ways, and what the law requires. When we no longer need personal information, we delete it, de-identify it or set it aside from further use.

Security

We take reasonable measures designed to protect the personal information we collect. No method of sending information over the internet or storing it electronically is completely secure, so we cannot guarantee the security of your personal information.

Children

The Site is meant for businesses and is not intended for anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact privacy@telgrow.ai and we will delete it as the law requires.

Where information is processed

We operate in the United States, and the Site is intended for visitors in the United States. Our service providers, including Cloudflare, may process information in other countries, where privacy laws may not be as protective as those where you live.

Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date at the top of this page and post the updated policy on the Site, or tell you in another appropriate way. Changes take effect when we post them unless we say otherwise. If you keep using the Site after an update takes effect, the updated policy applies to your use of the Site and your interactions with us.
