Who this policy applies to
This Acceptable Use Policy (“Policy”) explains what you may and may not do when you use the website operated by Telgrow, LLC (“Telgrow,” “we,” “us” or “our”) at telgrow.ai, demo.telgrowth.com and any other website we operate that links to this page (the “Site”), or the Telgrow platform (the “Platform”). Together, the Site and the Platform are the “Services.”
This Policy applies to every business that uses the Platform under a customer agreement with Telgrow (a “customer”), to everyone who uses the Services through a customer’s account, and to every visitor to the Site (“you”). It is part of our Terms of Service for the Site, and it adds to the customer agreement for the Platform. If a customer agreement sets stricter rules, those rules also apply.
Customers are responsible for making sure their employees, contractors, agents, lead vendors and anyone else using the Platform on their behalf follow this Policy.
Follow the law
You must use the Services only in ways that comply with every law and regulation that applies to you and to the people you contact, including:
- the Telephone Consumer Protection Act (TCPA) and the Federal Communications Commission’s (FCC) rules under it;
- the Federal Trade Commission’s Telemarketing Sales Rule (TSR);
- state telemarketing, Do Not Call and texting laws;
- federal and state laws on recording calls;
- privacy, data protection and consumer protection laws; and
- the rules for your industry, such as licensing requirements for insurance, mortgage and home improvement sales, and federal rules for marketing Medicare plans.
When you use the Platform to call or text people, you are responsible for your campaigns: whom you call, the consent you rely on, and following these laws. Where Telgrow places calls or runs AI agents for you, your customer agreement sets out each party’s role. Telgrow’s compliance features help, but they do not replace your own compliance program or legal advice. Our TCPA Notice summarizes the main federal rules.
Consent before you call or text
- Get the consent the law requires before you call or text. For telemarketing calls or texts that use automated dialing technology or an artificial or prerecorded voice, and that includes AI-generated voices, this generally means the prior express written consent of the person you are calling.
- Make sure the consent covers you. Each consent must clearly authorize the business on whose behalf you are calling, cover the type of call or text you are making, and cover the number you are calling.
- Keep proof of every consent. Keep a record of who gave consent, when and how they gave it, the exact wording they agreed to and the number it covers. Telgrow’s consent timestamps and audit trail can help, but you are responsible for having complete records.
- Do not rely on consent you cannot verify. Do not upload or dial lead lists unless you know how the consent was collected and can produce it if asked.
- Stop when consent is withdrawn. Do not call or text anyone who has withdrawn consent, however they told you.
Do Not Call lists and opt-outs
- Check the Do Not Call lists. Before making telephone solicitations, check numbers against the National Do Not Call Registry and any applicable state Do Not Call lists, unless an exemption applies and you can document it.
- Keep your own Do Not Call list. Record every request not to be called, honor it within the time the law requires, and keep honoring it for as long as the law requires.
- Honor opt-outs made in any reasonable way, including replies such as STOP to a text, a request made to a live person or AI agent on a call, or a key-press opt-out on an automated call.
- Offer the opt-outs the law requires, including the automated opt-out mechanism required on prerecorded and artificial voice telemarketing calls.
- Do not work around our safeguards. Do not disable, bypass or override Telgrow’s litigator or Do Not Call scrubbing or blocked-number lists, and do not re-upload or manually dial numbers they blocked.
How you call: hours, identity and caller ID
- Respect calling hours. Do not make telephone solicitations before 8 a.m. or after 9 p.m. in the called person’s local time, and follow any stricter hours or call-frequency limits set by state law.
- Say who you are. Identify yourself, the business on whose behalf you are calling and a phone number or address where that business can be reached. Prerecorded and AI voice calls must name the business at the start of the call and give a phone number where people can ask not to be called.
- Make the disclosures sales calls require, such as the identity of the seller, that the purpose of the call is to sell something, and what is being sold.
- Send accurate caller ID. Transmit a phone number, and a name where your carrier supports it, that identifies you or the seller and can be called back. Never use a number you do not have the right to use, and never spoof or falsify caller ID.
- Keep abandoned calls within the legal limits. Set dialer pacing so that each campaign stays within the federal limits on abandoned calls, and play the required message when no representative is available.
- Do not call protected lines using automated technology or an artificial or prerecorded voice, except as the law allows. These include emergency lines (such as those of hospitals, health care facilities, fire departments and police) and the guest or patient rooms of hospitals, health care facilities and elderly homes.
Call recording and AI voice agents
- Get recording consent where it is required. Some states require every person on a call to agree before it is recorded. Give the notices and get the consents that apply to each call you record.
- Treat AI voices as artificial voices. Calls that use the Platform’s AI voice agents, including the AI Closer, are subject to the same consent, identification and opt-out rules as prerecorded and artificial voice calls.
- Do not impersonate anyone. Do not use AI voices or scripts to impersonate a real person, another business, a government agency or Medicare, or to suggest an endorsement you do not have.
- Do not clone voices without permission. Do not create or use an AI copy of a real person’s voice without that person’s written permission.
- Do not mislead people about AI. Do not use AI voice agents to deceive people about whether they are talking to a person, including by denying that the agent is automated when someone asks, and follow any state law that requires you to disclose the use of AI.
- Own what your agents say. You are responsible for the scripts, prompts, offers and statements your AI agents and human representatives make. Do not have an AI agent say anything you could not lawfully say through a human representative.
Lead lists and data enrichment
- Use only data you are allowed to use. Upload or connect only data that was collected lawfully, with the notices and consents the law requires, and that you have the right to use for your campaign.
- Enrichment does not create consent. A phone number found through data enrichment does not come with consent to call or text it. Use enrichment results only in ways that match the consent you hold, the law and the terms of the data source.
- No eligibility decisions. Do not use enrichment results, lead scores or other Platform data to decide whether someone is eligible for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act.
- Keep sensitive data out unless you need it. Do not upload Social Security numbers, financial account numbers, health information or other sensitive data unless you are allowed to use it and actually need it for your campaign.
- Do not resell Platform data. Do not sell, license or share data obtained through the Platform, including enrichment results, except as your customer agreement allows.

Enforcement
If we believe you have broken this Policy, or that your use of the Services creates legal, security or reputational risk for Telgrow, our customers, carriers or the people being called, we may:
- investigate, including by reviewing account activity, call records and content;
- pause or block campaigns, numbers or messages;
- suspend or limit access to the Services, or close accounts;
- remove or disable content; and
- report activity to, and cooperate with, law enforcement, regulators, phone carriers and industry efforts to trace illegal calls, including by sharing information as the law allows.
We may act without notice when we believe it is needed to prevent harm or comply with the law. These steps are in addition to any rights we have under the Terms of Service or a customer agreement. We are not required to monitor your use of the Services, and our enforcement of this Policy does not make Telgrow responsible for your compliance.
Changes and contact
We may update this Policy from time to time. We will update the effective date at the top of this page and, for material changes, tell customers in an appropriate way. If you keep using the Services after an update takes effect, the updated Policy applies.
